OPEN MEDICAL PRIVACY POLICY EU & IRELAND

This privacy notice aims to inform you about how we collect and process any information that we collect from you or that you provide to us via this website.

We are Open Medical (Europe) Limited, a medical software development company registered in Ireland under company number 723401. Our Data Protection Officer may be contacted by email at dpo@openmedical.ie or by telephone at 012640638.

This privacy notice covers information that could identify you (“personal information”) and information that could not. In the context of the law and this notice, “process” means collecting, storing, transferring, using, or otherwise acting on information. It tells you about your privacy rights and how the law protects you.

We are committed to protecting your privacy and the confidentiality of your personal information. Our Data Protection policy is not just an exercise in complying with the law but a continuation of our respect for you and your personal information. A copy is available upon request from our Data Protection Officer.

We undertake to preserve the confidentiality of all information you provide to us. Our policy complies with the Data Protection Act 2018 (DPA) for Ireland and the EU General Data Protection Regulation (GDPR), particularly Article 8 of the Charter of Fundamental Rights of the European Union.

The law requires us to tell you about your rights and our obligations to you in regard to the processing and control of your personal data. Except as set out below, we do not share, sell, or disclose to a third party any information collected through our website.

Your rights

Under the EU GDPR Legislation, you have the following rights, which we will always work to uphold as set out in more detail below:

  • The right to be informed about our collection and use of your personal data - this Privacy Notice should tell you everything you need to know, but you can always contact us to find out more or to ask any questions through our Data Protection Officer, whose details are given above

  • The right to access the personal data we hold about you

  • The right to have your personal data rectified

  • The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we hold

  • The right to restrict (i.e. prevent) the processing of your personal data

  • The right to object to us using your personal data for a particular purpose or purposes

  • The right to withdraw consent

That data is processed using automated means. In many cases, you can ask us for a copy of that personal data to reuse with another service or business.

  • Rights relating to automated decision-making and profiling - we do not use your personal data this way.

Further information about your rights can be obtained from the European Data Protection Supervisor (EDPS) or your local Data Protection Authority (DPA).

Data we process

We may collect, use, store and transfer different kinds of personal data about you. We have collated these into groups as follows:

  • Your identity includes information such as first name, last name, title, date of birth, and other identifiers you may have provided at some time.

We may aggregate anonymous data, such as statistical or demographic data, for any purpose. Anonymous data is data that does not identify you as an individual. Aggregated data may be derived from your personal data but is not considered personal information in law because it does not reveal your identity. For example, we may aggregate profile data to assess interest in a product or service or use aggregated anonymised data for research purposes.

However, suppose we combine or connect aggregated data with your personal information so that it can identify you in any way. In that case, we treat the combined data as personal information, and it will be used in accordance with this privacy notice.

We will only store your personal data in the United Kingdom. We are compliant with the transfer of personal data outside of the European Union according to the EU GDPR and DPA 2018. You can expect a similar degree of adequate protection under UK GDPR with respect to your personal data.

The security of your personal data is essential to us. To protect your data, we take a number of important measures, including the following:

  • By implementing policies and procedures for dealing with data breaches (the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, your personal data), including notifying you and/or the DPA where we are legally required to do so.

A copy of our Information Governance pack containing these policies and procedures may be requested from our Data Protection Officer.

Special personal information is data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We may collect special personal information about you only if there is a lawful basis on which to do so.
